    Why it may be hard to access CBD oil

    While scientific studies and anecdotal evidence show that CBD oil has lots of health benefits, it is not always easy to get CBD oil and other CBD products. This is especially true in some parts of the country.

    Why is it so hard?

    Well, it’s largely because, until last year, hemp was a controlled substance. Even though that’s no longer true, the policy change at the federal level hasn’t made it to state and local authority levels yet.

    Hemp and marijuana close relationship, (they’re basically “cousins”) hasn’t helped matters either. Out of ignorance, many people still mistakenly think that CBD oil is marijuana and clamp down (unnecessarily) on this harmless product.

    Hemp products aren’t new in New York State or New York City. Back in the 1940s, New York used the movie Hemp for Victory to promote growing help for products, such as fabrics and other industrial products needed during the Second World War.

    After the war, strict restrictions and heavy taxes were re-imposed on hemp and the cultivation of the crop no longer made economic sense.

    Since then, New York enacted several laws that support the hemp industry. The most recent was a bill signed by Gov. Cuomo in 2017 acknowledging the massive potential of the hemp industry.

    The Farm Bill signed in 2018 rescheduled hemp from a controlled substance to an ordinary agricultural product like corn. While the law didn’t specifically mention CBD, it left states free to enact their own detailed regulations for the hemp industry. In effect, this federal law legalized CBD oil and other hemp-derived products.

    Currently, CBD oil is legal in New York City. However, the city has decided to take the same position as the federal government by banning edibles infused with CBD. Establishments that sell CBD drinks and other CBD-infused products, therefore, risk enforcement action.

    However, chances are the position of NYC, and New York State will change once the FDA adjusts its position on CBD-infused products. For now, you can be content with buying CBD oil and using it as you wish.

    Why you can’t grow your own CBD oil

    You may be asking yourself, “Is it possible or even legal to grow my own CBD oil in New York City?”

    First of all, you would have to find a source of hemp clones or feminized seeds to grow. This is a difficult task to accomplish because the few commercial growers of industrial hemp aren’t interested in handing over their high-quality seeds to DIYers.

    But there’s more.

    Hurdle number two has to do with the law. As you may know, the debate on whether recreational marijuana should be legalized in New York State is still ongoing. As things stand, you will be breaking the existing law if you decided to grow marijuana for CBD oil extraction. New York City also doesn’t yet have regulations that define how growers can cultivate hemp for personal use.

    If that wasn’t enough,

    the potency of CBD oil is important when used for therapeutic benefits. CBD levels below a certain point are no longer effective, and a too-high CBD potency changes its effectiveness as well. How would you know that your home-extracted CBD oil makes the cut? You won’t, so you could be wasting time-consuming that oil if you don’t know what concentration of CBD it has.

    The most feasible option to enjoy the numerous benefits of CBD oil is to buy it rather than trying to grow plants and extract it by yourself. Many retail shops, such as vape shops, carry CBD oil and other CBD products, so you could always buy your supply from them.

    However, the absence of legal regulations (for now) means that you never really know how good a product in one of these shops is.
